TERMS AND CONDITIONS

INVOICES: All invoices will include a $5.00 California hazardous material fee.

PRICES: All prices are F.O.B. our Warehouse.

PAYMENT TERMS: Thirty (30) days net on open accounts. VISA & Master Card accepted for net invoice amount. All others are C.O.D. Certified funds only. International orders are VISA or Master Card only.

OPEN ACCOUNTS: Open accounts are available on approved credit.

QUOTATIONS: Quotations are subject to prompt acceptance by our customer. We reserve the right to correct typographic errors and reject orders if credit is found unsatisfactory. Prices submitted do not include sales tax.

DAMAGE CLAIMS: If your shipment appears damaged, open immediately and report any damage to carrier.

RETURNED GOODS: No return authorization number is required. All merchandise must be returned within 30 days of purchase. A 15% restocking fee will be required. Custom built exhaust systems are non returnable. Customer is responsible for inbound and outbound shipping charges on all returnable items.

SHORTAGES OR MISMATCHED PARTS: All claims for shortages or mismatched parts must be made within fifteen (15) days or they will not be allowed.

LIMITED WARRANTY: Our only obligation is to repair or replace any item proved to be defective in materials or workmanship for a period of one (1) year unlimited hours. ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ARE DISCLAIMED.

LIABILITY: Acceptance of any order is conditioned on buyer's acceptance of these term's. WE SHALL NOT BE LIABLE WHETHER IN CONTRACT, IN TORT, UNDER ANY WARRANTY, IN NEGLIGENCE OR OTHERWISE, FOR CONSEQUENTIAL, SPECIAL OR INCIDENTAL DAMAGES. UNDER NO CIRCUMSTANCES SHALL OUR LIABILITY EXCEED THE AMOUNT OF THE PURCHASE PRICE. THE BUYER'S LIMITED RIGHT TO REPLACEMENT IS THE BUYER'S SOLE AND EXCLUSIVE REMEDY.
